1. Acceptance of Terms

By accessing or using VoiceRay ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all users, including parents, guardians, educators, and children using the platform.

2. Service Description

VoiceRay is an AI-powered speech therapy platform designed to support children with autism, speech delays, and language learners. Our services include:

• AI voice coach for speech practice
• Social skills learning through interactive cards
• Progress tracking and analytics
• Personalized feedback and recommendations

3. User Accounts and Eligibility

To use VoiceRay, you must:

• Be at least 18 years old or have parental/guardian consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Parental Consent and Supervision

VoiceRay is designed for children. Parents or legal guardians must create accounts on behalf of children under 13 and supervise their use of the Service. By creating a child profile, you confirm that you are the parent or legal guardian and consent to the child's use of VoiceRay.

5. Subscription and Payment

VoiceRay offers free and paid subscription plans:

• Free Plan: Limited daily sessions with basic features
• Premium Plan: Unlimited sessions and advanced features
• Family Plan: Multiple child profiles with full access

Subscriptions renew automatically unless cancelled. You may cancel at any time, and cancellation will take effect at the end of the current billing period. No refunds are provided for partial months.

6. Acceptable Use

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Harass, abuse, or harm other users
• Use automated systems to access the Service
• Reverse engineer or copy our AI models

7. AI and Speech Analysis - Important Disclaimers

NOT A MEDICAL DEVICE OR PROFESSIONAL THERAPY: VoiceRay is an educational and practice tool built from real-world experience of the founders. It is NOT a medical device, diagnostic tool, or replacement for professional speech therapy services.

AI Limitations: Our AI provides feedback based on patterns and algorithms. AI can make mistakes, provide inaccurate feedback, or miss important speech issues. Do not rely solely on VoiceRay for speech development.

Professional Consultation Required: Always consult with licensed speech-language pathologists, pediatricians, or other qualified healthcare professionals for:

• Diagnosis of speech or language disorders
• Treatment planning and therapy
• Medical advice or recommendations
• Assessment of your child's progress

Founder Experience Basis: VoiceRay is built based on the founders' personal experiences supporting children with speech delays. Features reflect what worked in their experience but may not work for all children. Every child is unique and may require different approaches.

8. Intellectual Property

All content, features, and functionality of VoiceRay, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the property of IshAum LLC and are protected by copyright, trademark, and other intellectual property laws.

9. User Content and Voice Data

By using VoiceRay, you grant us a limited license to:

• Process voice recordings for speech analysis
• Store practice session data for progress tracking
• Use anonymized data to improve our AI models

You retain ownership of your voice recordings and can delete them at any time through your account settings.

10. Comprehensive Disclaimers and Limitations

NO WARRANTIES: VoiceRay is provided "AS IS", "AS AVAILABLE", and "WITH ALL FAULTS" without warranties of any kind, either express or implied, including but not limited to:

• No warranty of merchantability or fitness for a particular purpose
• No guarantee of uninterrupted, timely, secure, or error-free service
• No guarantee of specific speech improvement, progress, or outcomes
• No warranty regarding accuracy, reliability, or completeness of AI feedback
• No guarantee of compatibility with all devices or operating systems
• No warranty that the Service will meet your specific needs or expectations

EXPERIMENTAL NATURE: You acknowledge that VoiceRay is built based on the founders' personal experiences and observations. What worked for the founders' children may not work for yours. Results vary significantly between individuals.

USE AT YOUR OWN RISK: You use VoiceRay entirely at your own risk. We make no representations about the suitability of the Service for any child or purpose.

NO PROFESSIONAL ADVICE: Nothing in VoiceRay constitutes professional medical, therapeutic, educational, or other professional advice. Always seek professional guidance for your child's specific needs.

11. Maximum Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

IN NO EVENT SHALL ISHAUM LLC, ITS FOUNDERS (PALLABI CHAKRABORTY AND VAIBHAV SRIVASTAVA), OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR SUPPLIERS BE LIABLE FOR ANY:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the Service
• Damages resulting from any unauthorized access to or use of our servers
• Damages resulting from any interruption or cessation of the Service
• Damages resulting from any bugs, viruses, or other harmful code
• Damages resulting from any errors, mistakes, or inaccuracies in AI feedback
• Personal injury, property damage, or any harm to your child
• Damages resulting from reliance on information provided by the Service
• Damages arising from any third-party content or conduct

MAXIMUM LIABILITY CAP: Our total aggregate liability for all claims shall not exceed the greater of (a) $100 USD or (b) the amount you paid to IshAum LLC in the 12 months before the claim arose.

ESSENTIAL PURPOSE: These limitations apply even if we have been advised of the possibility of such damages and even if any remedy fails of its essential purpose.

FOUNDER PROTECTION: The founders, Pallabi Chakraborty and Vaibhav Srivastava, are building this tool based on their personal experiences as parents. They are not acting as medical professionals or therapists. No claims shall be brought against them personally.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease, and we may delete your account data.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes via email or through the app. Your continued use of VoiceRay after changes constitutes acceptance of the modified Terms.

14. Dispute Resolution and Arbitration

BINDING ARBITRATION: Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.

CLASS ACTION WAIVER: YOU AND ISHAUM LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You waive any right to a jury trial.

Arbitration Rules: The arbitration will be conducted by the American Arbitration Association (AAA) under its rules. The arbitrator's decision will be final and binding.

30-Day Right to Opt Out: You have the right to opt out of arbitration by sending written notice to legal@voiceray.com within 30 days of first accepting these Terms.

Governing Law: These Terms shall be governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
